PeakWave Privacy Policy

This Privacy Policy explains how Ascendward, LLC d/b/a PeakWave ("PeakWave," "we," "us," or "our") collects, uses, discloses, and otherwise processes personal information in connection with our websites, applications, hosted platform, AI-powered services, and related offerings (collectively, the "Services").

PeakWave is a business and professional software service. This Privacy Policy applies to information we collect when you visit PeakWave.ai, create or administer an account, use the Services, communicate with us, or otherwise interact with us in a business or professional context.

By using the Services, you acknowledge the collection, use, disclosure, and processing practices described in this Privacy Policy.

1. Scope and Relationship to Customer Accounts

In many cases, PeakWave provides the Services to organizations, teams, and businesses that control a PeakWave account (each, a "Customer"). When you use the Services through a Customer account, that Customer may control the account, its workspaces, its users, its integrations, and much of the content submitted to the Services. In those situations, we process information on behalf of the Customer and under our agreements with that Customer.

If you have questions about specific workspace content, imported data, or how an organization uses the Services, you should also direct your request to the relevant Customer or workspace administrator.

2. Information We Collect

We collect information from several sources and in several ways.

2.1 Information You Provide Directly

We may collect the following information directly from you or your organization:

  • account registration information, such as your name, work email address, password, company name, team name, job title, billing contact details, and account preferences;
  • profile information, workspace settings, and administrative information;
  • content you submit to the Services, including feedback notes, ideas, tags, attachments, comments, customer records, user records, uploads, prompts, instructions, and related content;
  • communications you send to us, including support requests, sales inquiries, security inquiries, feedback, testimonials, survey responses, and other messages;
  • payment and transaction information, such as billing contact details, subscription details, invoice information, and limited payment-related metadata processed through our payment providers;
  • marketing and event information, such as form submissions, demo requests, webinar registrations, and newsletter preferences; and
  • any other information you choose to provide to us.

2.2 Information We Collect Automatically

When you use the Services or visit our websites, we and our service providers may automatically collect certain information, including:

  • device, browser, operating system, and network information;
  • IP address, approximate location derived from IP address, language, referring URLs, and general traffic data;
  • account activity, feature usage, event data, page views, clicks, navigation paths, interaction timing, crash data, and performance logs;
  • authentication events, security logs, audit trails, and administrative actions;
  • cookies, local storage, similar technologies, and identifiers used to operate, secure, personalize, and analyze the Services; and
  • session replay or similar product analytics data that helps us understand how users navigate and interact with the Services, diagnose issues, improve usability, and support customers.

2.3 Information We Receive from Customers and Third Parties

We may receive information from Customers, Users, integrations, and other third parties, including:

  • customer-uploaded or customer-synced data from support tools, CRM systems, forms, websites, chat tools, email systems, call or meeting tools, review platforms, analytics tools, and similar business systems;
  • contact and company information about Customer personnel, end users, prospects, customers, or other business contacts;
  • information from payment processors, authentication providers, infrastructure providers, and fraud or security services;
  • marketing and referral information from advertising, analytics, or event partners; and
  • information from publicly available sources where permitted by law.

2.4 AI-Related Inputs and Outputs

Because AI-powered functionality is an inherent part of the Services, we may collect and process:

  • prompts, instructions, text, notes, attachments, and other inputs submitted to AI-powered features;
  • outputs, summaries, classifications, tags, clusters, recommendations, associations, rankings, and other content generated by or with AI-powered features; and
  • signals relating to how users interact with AI-powered features, such as acceptance, rejection, correction, editing, labeling, and workflow actions.

2.5 Sensitive Data Restrictions

PeakWave is not intended to receive or process highly sensitive or regulated personal information except as expressly permitted in our Terms of Service or a separate written agreement signed by PeakWave. Please do not submit health information, payment card information, Social Security numbers, government identification numbers, biometric data, data about minors, legal privileged matter data, or similarly sensitive data through the Services.

3. How We Use Information

We may use personal information and related data for the following purposes:

  • to provide, host, operate, maintain, support, secure, and improve the Services;
  • to create and manage accounts, authenticate users, administer workspaces, and provide customer support;
  • to process subscriptions, billing, payments, renewals, and account administration;
  • to provide AI-powered features and related automation, including summarization, extraction, classification, tagging, clustering, deduplication, recommendation, linking, ranking, and workflow support;
  • to monitor usage, analyze trends, measure feature adoption, troubleshoot issues, detect errors, and improve the performance, usability, and reliability of the Services;
  • to personalize product experiences, surface relevant content, and improve workflows;
  • to develop, evaluate, test, tune, and improve existing and future Services, features, analytics, machine learning systems, and AI capabilities;
  • to communicate with you about the Services, updates, support matters, security alerts, legal notices, and administrative issues;
  • to send marketing communications, product announcements, event invitations, newsletters, and other promotional messages in accordance with applicable law and your communication preferences;
  • to investigate, prevent, detect, and address fraud, abuse, unauthorized access, security incidents, policy violations, and illegal activity;
  • to enforce our Terms of Service and other agreements;
  • to comply with legal obligations, protect rights and safety, and respond to lawful requests; and
  • to create aggregated, de-identified, or anonymized insights, metrics, analytics, benchmarks, models, and learnings for lawful business purposes.

4. AI and Automated Processing

PeakWave uses automation and AI-powered features as part of the Services. These features may process account content, customer records, notes, ideas, prompts, interaction data, and related information to generate outputs, assist workflows, and improve the Services.

AI-powered features may summarize content, extract information, classify data, apply or recommend tags, cluster similar records, suggest relationships, merge or deduplicate items, prioritize items, and support other internal workflow actions within the Services.

We may use personal information and other data submitted to or generated through the Services to operate, evaluate, improve, train, tune, and develop our AI-powered features and related functionality. We may also transmit relevant data to third-party AI providers we use to help power those features.

AI-generated or AI-assisted outputs may be inaccurate, incomplete, or non-unique. Human review remains important.

5. Cookies, Analytics, and Session Replay

We and our service providers use cookies, SDKs, pixels, local storage, and similar technologies to operate and secure the Services and to collect analytics information.

These technologies may be used to:

  • keep you signed in and remember your preferences;
  • understand traffic patterns and usage behavior;
  • analyze feature adoption and user journeys;
  • troubleshoot and debug technical issues;
  • improve product design and usability; and
  • measure the effectiveness of site pages, communications, and campaigns.

We may use product analytics and session replay tools that record or reconstruct how users interact with our sites and applications, such as pages visited, clicks, scrolls, form interactions, navigation flow, timestamps, device and browser data, and similar usage information. Depending on how our tools are configured, some text or input fields may be masked, excluded, or otherwise limited before transmission.

Your browser or device may allow you to manage cookies or similar technologies. However, disabling certain technologies may affect the functionality of the Services.

6. How We Disclose Information

We may disclose personal information and related data in the following circumstances:

6.1 Service Providers and Contractors

We may disclose information to vendors, service providers, contractors, and subprocessors that perform services on our behalf or help us operate the Services, such as providers for hosting, cloud infrastructure, databases, analytics, authentication, communications, payment processing, customer support, monitoring, error tracking, AI processing, email delivery, and professional services.

These providers may include companies such as infrastructure and database providers, analytics providers, payment processors, AI model providers, and communications providers, and may include providers such as Supabase, Vercel, PostHog, Stripe, OpenAI, Anthropic, and Google or Google Gemini, depending on how we configure the Services from time to time.

6.2 Within Customer Workspaces

Information may be disclosed within a Customer's workspace or account to administrators, authorized users, and others designated by the Customer.

6.3 Integrations and Customer-Directed Disclosures

If you enable integrations, connect third-party services, use imports or exports, publish or share content, or otherwise direct us to disclose information, we may disclose information consistent with your instructions and the functionality you use.

6.4 Affiliates and Business Transfers

We may disclose information to our affiliates and in connection with an actual or proposed merger, acquisition, financing, investment, restructuring, bankruptcy, sale of assets, or other corporate transaction.

6.5 Legal, Safety, and Protection Reasons

We may disclose information when we believe disclosure is necessary to:

  • comply with applicable law, regulation, legal process, subpoena, court order, or governmental request;
  • enforce our agreements, policies, and rights;
  • detect, investigate, or prevent fraud, security incidents, abuse, or illegal activity;
  • protect the rights, property, safety, or security of PeakWave, our customers, users, or others; or
  • establish, exercise, or defend legal claims.

6.6 Aggregated and De-Identified Information

We may disclose aggregated, anonymized, or de-identified information that does not identify a particular individual or reasonably reveal Customer confidential information.

7. How We Use Data for Marketing

We may use contact information and limited professional information to market the Services, communicate about product updates, invite you to events, and share content we think may interest you. You may opt out of marketing emails by using the unsubscribe mechanism in those emails or by contacting us at hi@peakwave.ai.

If a Customer approves a testimonial, quote, case study statement, endorsement, or similar content in writing, we may use that approved content in our marketing and promotional materials.

8. Legal Bases and U.S. State Privacy Disclosures

PeakWave is a U.S.-based business software provider and primarily markets and sells in the United States. Depending on where you live and the context in which we process your information, you may have privacy rights under applicable state laws.

Subject to applicable law, verification, and available exceptions, you may have the right to request that we:

  • confirm whether we process your personal information;
  • provide access to certain personal information;
  • correct inaccurate personal information;
  • delete certain personal information;
  • provide a portable copy of certain personal information; or
  • explain our processing practices.

If we process your information on behalf of a Customer, we may direct your request to that Customer or ask you to submit your request through that Customer.

Unless we state otherwise, PeakWave does not sell personal information for money. PeakWave also does not use personal information for cross-context behavioral advertising through the Services.

9. Data Retention

We retain personal information and related data for as long as we reasonably determine is necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business records, support legitimate business operations, enforce agreements, resolve disputes, comply with legal obligations, and protect the Services and our users.

Retention periods may vary based on the nature of the information, the sensitivity of the information, the Services and features used, Customer instructions, applicable contractual commitments, our backup and disaster recovery practices, legal requirements, and operational needs.

We may retain logs, backups, security records, billing records, support records, and de-identified or aggregated information for longer periods.

10. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no security measure is perfect, and no system or transmission can be guaranteed to be completely secure.

You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying us of suspected unauthorized use or security incidents involving your account.

11. International Processing

PeakWave is based in the United States, and we and our service providers may process information in the United States and other countries where we or our providers operate. Those countries may have data protection laws that differ from those in your jurisdiction.

12. Children's Privacy

The Services are intended for business and professional use and are not directed to children. We do not knowingly collect personal information from children under 18 through the Services. If you believe a child has provided personal information to us, please contact us at hi@peakwave.ai.

13. Third-Party Sites and Services

The Services may link to or interoperate with third-party websites, tools, and services. We are not responsible for the privacy practices of third parties, and their practices are governed by their own terms and privacy policies.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we may provide notice by posting the updated Privacy Policy on our website, through the Services, by email, or by other reasonable means. The "Last Updated" date above indicates when this Privacy Policy was last revised.
